CRAZYPUB PUBLIC AGREEMENT-OFFER

This public Agreement-Offer (the «Agreement») governs the relationship between the Project Administration (Individual Entrepreneur Efim Igorevich Burylov) and the natural person using the website crazypub.gg and its sub-domains.
The Administration may at any time unilaterally amend the terms of this Agreement. The new version of the Agreement takes effect from the date of its publication on the Site.
This is a translation of the Russian text; the Russian version prevails (governing law - the Russian Federation).

1. Definitions

«Site» / «Platform» - the internet resource hosted at crazypub.gg, as well as all its sub-domains, including any related web pages, services and functional elements.
«Administration» - Individual Entrepreneur Efim Igorevich Burylov (INN 111100843541, OGRNIP 326110000016787), who operates the Site, manages its functionality and provides services to users.
«User» - a natural person who has reached the age of 14 (or 16 for residents of the European Union), having the necessary legal capacity under applicable law and using the Site in the manner provided by these terms.
«Game» - the computer game Counter-Strike 2, developed and released by Valve Corporation, including all its updates, patches and modifications.
«Account» - the User's record on the Site, created and used to access the platform functionality and linked to the unique user identifier in the Steam service (SteamID64).
«SteamID64» - the unique 64-bit identifier of the User's account in the Steam online service owned by Valve Corporation, used for authentication and linking of the account on the Site.
«Shop» - the section of the Site that allows the User to acquire Virtual Goods using the Site's internal accounting units (CrazyCoin) in accordance with the established rules and conditions.
«Virtual Good» (the «Content») - a digital right to use additional functional capabilities of the Game and/or Site (including, but not limited to, privileges, visual design elements (skins), in-game items and other intangible assets), granted to the User.
«CrazyCoin» - an internal notional unit of account of the User's balance on the Site, used solely to purchase Virtual Goods in the Shop. CrazyCoin is not money, currency of the Russian Federation, foreign currency, digital currency, digital financial asset, electronic means of payment within the meaning of Federal Law No. 161-FZ «On the National Payment System», a security or any other financial instrument, nor a monetary obligation of the Administration to the User. CrazyCoin is not subject to exchange for money, withdrawal in cash, transfer to other users or refund.

1.1. Game terms
Within this Agreement and the rules for using the game servers, the following terms apply:
CT (Counter-Terrorists) - a team of players whose main task is to survive and avoid detection by a player of the T team.
T (Terrorist/Maniac) - a player whose duties include detecting and eliminating all members of the CT team.
AFK (Away From Keyboard) - a state of temporary absence of active control of the game character by the user, in which the character remains in the game world without actions by the player.
DD (DoubleDuck) - a game technique consisting of performing a double crouch, used to implement the G strafe (dd-run) technique.
LJ (LongJump) - a long-jump technique that allows covering increased distances in the game space.
HP (Health Points) - an indicator of the current health state of the game character, expressed in notional units.
Tricks - a sequence of game actions (combinations of movements) aimed at disorienting the opponent and gaining a tactical advantage.
Surf - inclined surfaces at a certain angle along which a player can slide.
DMG (Damage) - the amount of game damage dealt or received, expressed in notional units.
WallBug - a game technique using the features of map textures and geometry for a safe descent from a height without taking damage.

1.2. Terms relating to the hierarchy and roles of users in the game
Administration (Administrator) - a general concept denoting persons vested with special rights and obligations to manage the game project and control compliance with the rules. The Administration includes:
Project Management - persons exercising general management of the project, namely the Creator, the Head.
Senior Administration - persons with extended powers, namely the Curator, the Chief Administrator (Chief Admin), the Deputy Chief Administrator.
Supervising departments - persons responsible for monitoring compliance with the rules in specific areas, namely the Complaints Supervisor, the Administration Supervisor, the Trainees Supervisor.
Recruited administration - users accepted to the relevant positions within the established procedure, namely Trainee, Helper, Moderator, Senior Moderator.
Privileged users - users who, in the established order, are granted additional functional capabilities or a special status within the game project, including: VIP players (VIP) - users with additional privileges in accordance with the terms of granting VIP status. Users with purchased administrative rights (Purchased administration) - users who received a limited set of administrative rights by purchasing the corresponding privilege («ADMIN» or «PRO ADMIN») in the official project shop.

2. Subject of the Agreement

2.1. Under this Agreement the Administration grants the User the right to use the Site and its services, as well as access to Virtual Goods on a paid basis in the manner and on the conditions provided by this Agreement and the Project Rules.
2.2. This Agreement is a public offer in accordance with Article 426 of the Civil Code of the Russian Federation. The Agreement is deemed concluded from the date the User performs one of the following actions:
the first actual use of the Game in connection with the operation of the Site;
payment for any of the paid services or Virtual Goods on the Site.
2.3. Acceptance of the offer (acceptance of the terms of this Agreement) is deemed to be the User's performance of the actions specified in clause 2.2 of this Agreement. By accepting, the User confirms that they have read the text of this Agreement and the Project Rules, accepts all terms of the Agreement and the Project Rules, and has the necessary legal capacity to conclude this Agreement.
These terms of the Agreement are binding on all Users without exception, regardless of their status, sex, nationality or religion.
The Project Rules are publicly available on the Site at: https://crazypub.gg/help#cat=1&sub=2.
2.4. If the User disagrees with any provisions of this Agreement and/or the Project Rules, the User must immediately stop using the Site and any of its services. Continued use of the Site after reviewing the Agreement and the Project Rules is deemed acceptance of all its terms.

3. Virtual Goods

3.1. The Administration provides access to game servers, the personal account, statistics, the skin changer, bonuses and other services on an «as is» (AS IS) basis.
3.2. Virtual Goods exist solely in digital (intangible) form and have no physical equivalent. The User's rights in respect of Virtual Goods are determined solely by the terms of this Agreement.
3.3. All funds transferred by the User to the Administration in the course of using the Site constitute payment for granting the right to use the digital content (Virtual Goods) in the manner and on the conditions provided by this Agreement.
3.4. The right to use a Virtual Good is deemed granted to the User in full from the moment of its activation on the User's Account or on a game server, unless otherwise provided by special rules for individual categories of goods.
3.5. Virtual Goods:
are linked to the User's SteamID64 and are not transferable to other persons;
cannot be exchanged for money or other valuables;
are not part of inheritable property and do not pass by inheritance;
may be used solely within the functionality of the Site and the Game in accordance with the Project Rules.
3.6. Terms of use and cancellation of CrazyCoin. CrazyCoin is an internal notional unit of account of the User's balance on the Site, used solely to purchase Virtual Goods. In the event of termination of the Site's operation or blocking of the User's Account on the grounds provided by this Agreement and the Project Rules - unused CrazyCoin is cancelled without any compensation to the User.

4. Registration and Account

4.1. Access to the Account is via Steam Open ID authorization.
4.2. The User must maintain the confidentiality of their Steam data. All actions from the account are deemed performed by the User personally.
4.3. The Administration is not liable for theft of Steam accounts or the User receiving VAC bans from Valve.
4.4. In the event of loss of access to the Steam account, Virtual Goods are not subject to restoration to a new ID.

5. User Obligations

By using the Site, the User undertakes to:
5.1. Fully comply with the terms of this Agreement and the Project Rules publicly available on the Site. The User acknowledges that reviewing the said documents is their obligation before starting to use the Site.
5.2. Not infringe the intellectual property rights of the Administration or third parties, including (but not limited to) copyright, related rights, trademark rights and other protected results of intellectual activity.
5.3. Refrain from any actions capable of harming the operability of the Site and/or game servers, including:
using cheats, exploits, software bugs for selfish purposes;
using automation scripts, bots and other third-party software that affects the gameplay or the operation of the Site;
interfering with the operation of the Site software, its modification, decompilation or reverse engineering.
5.4. Refrain from posting and distributing on the Site and in the game chat information that:
is offensive, discriminatory or otherwise unlawful;
violates public order, moral norms and generally accepted ethical standards;
contains calls for unlawful actions, extremism, violence or other violations of the law.
5.5. Not use the Site's functionality for commercial purposes (including, but not limited to, reselling Virtual Goods, providing paid services using the Site, organizing gambling) without the Administration's prior written consent.
5.6. Not perform bad-faith payment-reversal actions (chargeback) after receiving a Virtual Good. Such actions: are qualified by the Administration as bad-faith conduct and abuse of right and may entail suspension or termination of the User's access to the Site. Bad-faith actions give the Administration the right to transfer information about such actions to the payment system and/or law enforcement authorities for consideration of holding the User liable in accordance with applicable law.
5.7. The User acknowledges and confirms that ignorance of the terms of this Agreement and/or the Project Rules does not release them from liability for their violation. The obligation to review the said documents lies with the User before starting to use the Site.

6. Administration Rights

6.1. The Administration may at any time and without explanation:
- change prices, the range and characteristics of Virtual Goods;
- make changes to the Site functionality;
- temporarily or permanently discontinue any service;
- perform technical works with temporary unavailability of the Site.
In addition, the availability of the Site and the servers associated with it may be limited or disrupted for reasons beyond the Administration's control, including in connection with:
scheduled and unscheduled updates of the game Counter-Strike 2 (CS2) performed by its developers;
technical works or failures on the side of the CS2 developers;
other actions or events by third parties affecting the operability of the game servers and the Site's integration with them.
6.2. The Administration may block or delete the User's account in case of:
- violation of this Agreement or the Project Rules;
- use of cheats or exploits;
- receiving a VAC ban on Valve's side;
- performing a chargeback or other bad-faith actions;
- insults towards the Administration or other users.
6.3. Upon blocking the account on the grounds of 6.2, all Virtual Goods and CrazyCoin are cancelled, refund of funds is not made.
6.4. If the User is inactive for more than 12 months, the Administration may delete the Account with all data.
6.5. In the event of a change of the game servers' IP address, all Virtual Goods are transferred to the new server automatically.

7. Payment Procedure and Delivery Terms for Virtual Goods

7.1. The price of each Virtual Good is shown on the relevant page of the Store (https://crazypub.gg/shop) in Russian roubles, inclusive of all applicable taxes. The price of CrazyCoin top-ups is shown in the User's Personal Account in the top-up section.
7.2. Payment for Virtual Goods and CrazyCoin balance top-ups is made by the User cashlessly using one of the following methods:
- bank cards of Visa, MasterCard and the national «Mir» payment systems;
- through the Faster Payments System (SBP) using the acquirer bank details;
- by other methods provided by payment services connected to the Site.
7.3. Payments are accepted via certified payment systems. The User's payment data (card number, CVV/CVC, expiration date) is entered exclusively on the side of the payment system and is not transmitted to, stored by or processed by the Administration.
7.4. The moment of fulfilment of the User's payment obligation is deemed to be the moment of receipt of funds in the Administration's settlement account or in the connected payment service.
7.5. Payment procedure:
- the User selects a Virtual Good on the Store page or specifies a CrazyCoin top-up amount;
- the User confirms agreement with the terms of this Agreement by ticking the appropriate box;
- the User is redirected to a secure page of the selected payment system, where the payment is made;
- upon successful payment confirmation by the payment system, the Virtual Good is automatically activated on the User's Account, and the corresponding record is displayed in the Personal Account and the transaction log.
7.6. Terms of delivery of Virtual Goods:
- Virtual Goods and CrazyCoin credit are provided to the User in electronic (digital) form automatically upon receipt of successful payment confirmation from the payment system - usually within a few seconds, but no later than 24 (twenty-four) hours from the moment of payment;
- in the event of a technical error or failure, the term of delivery of the Virtual Good shall not exceed 7 (seven) business days from the moment of payment;
- if, upon expiry of the said term, the Virtual Good has not been delivered due to the fault of the Administration, the User is entitled to request a refund in accordance with section 8 of this Agreement.
7.7. Confirmation of payment made and Virtual Good delivered shall be: the record of the transaction in the User's Personal Account on the Site, as well as the fiscal document (receipt) generated by the payment system and/or the fiscal data operator in accordance with Federal Law No. 54-FZ «On the Use of Cash Register Equipment». The fiscal document is sent to the User at the e-mail address linked to the Account or is available at the link provided by the payment system.
7.8. For all questions related to payment and delivery of Virtual Goods, the User may contact support at: partnership@crazypub.gg.

8. Refunds

8.1. Digital content (Virtual Goods) is not refundable after access is granted and use has begun, except in the cases specified in this section.
8.2. A refund may be made only in the event of a technical error (double payment) or if the good was not credited within 7 days through the Administration's fault.
8.3. A refund request is submitted to partnership@crazypub.gg within 14 days of the payment date.
8.4. The refund is made by the same method by which the payment was made, within 10 (ten) business days from the date the Administration confirms the refund request. In the event of erroneously credited funds, the refund is made within 3 (three) business days from the date the erroneous crediting is established.
8.5. A chargeback without prior contact with support leads to a permanent account block.

9. Limitation of Liability

8.1. The Administration is not liable for failures caused by Valve's actions, changes in the Steam API, DDoS attacks or sanctions.
8.2. The aggregate liability of IE Burylov E.I. to the User is limited to the amount of the User's payments for the last 6 months, but not more than 10,000 rubles.
8.3. The User undertakes to compensate the Administration for losses arising in connection with the User's violation of the terms of the Agreement.

10. Intellectual Property

9.1. All Site materials (design, texts, graphics, source code, the CRAZYPUB trademark, the domain name) are the intellectual property of the Administration.
9.2. Counter-Strike, Steam, Source Engine, related trademarks and game content are the property of Valve Corporation. CRAZYPUB is not affiliated with Valve Corporation.
9.3. Any copying, distribution, modification or other use of Site materials without the Administration's written consent is prohibited.

11. Dispute Resolution

10.1. All disputes arising out of or in connection with this Agreement are resolved by the Parties through negotiations.
10.2. A mandatory pre-litigation (pre-trial) dispute settlement procedure is established. Before applying to a court, the User must send a reasoned claim to the email address: partnership@crazypub.gg. The waiting period for a response to the claim is 60 (sixty) calendar days from the date of its receipt by the Administration.
10.3. This Agreement is governed by and construed in accordance with the legislation of the Russian Federation. All disputes not settled in the pre-trial procedure are subject to consideration in the competent court at the Administration's location.

12. Minor Users

11.1. The minimum age to use the Site is 14 (fourteen) years. For users located in jurisdictions establishing a higher age of consent (including European Union member states), the minimum age is 16 (sixteen) years.
11.2. Users aged 14 to 18 may use the Site solely with the prior written consent of parents or legal representatives. Upon registration the User confirms that they have obtained such consent if they have not reached the age of 18.

13. Procedure for Amending the Agreement

12.1. The Administration may unilaterally make changes and additions to this Agreement. The new version of the Agreement is published on the Site indicating the date of the changes.
12.2. Changes take effect no earlier than 7 (seven) calendar days from the publication of the new version on the Site, unless the Administration sets a longer period for the User to review the changes.
12.3. Continued use of the Site or its services after the changes take effect is deemed the User's acceptance of the new version of the Agreement. If the User does not agree with the changes made, they must stop using the Site.
13.4. The current version of the Agreement is always available for review at: https://crazypub.gg/oferta. The User must periodically check the said page for changes to the Agreement.

14. Final Provisions

13.1. If any provision of this Agreement is held by a court or other competent authority to be invalid or unenforceable in any part, this does not affect the validity of the remaining provisions of the Agreement.
13.2. This Agreement constitutes the agreement between the Parties regarding its subject matter and supersedes all prior arrangements, negotiations, promises and correspondence between the Parties concerning the subject matter of the Agreement, regardless of the form of their recording.
